Section 13 of the Fair trading Act 1986
No person shall, in trade, in connection with the supply or possible supply of goods or services or with the promotion by any means of the supply or use of goods or services,?
(a) make a false or misleading representation that goods are of a particular kind, standard, quality, grade, quantity, composition, style, or model, or have had a particular history or particular previous use; or
(b) make a false or misleading representation that services are of a particular kind, standard, quality, or quantity, or that they are supplied by any particular person or by any person of a particular trade, qualification, or skill; or
(c) make a false or misleading representation that a particular person has agreed to acquire goods or services; or
(d) make a false or misleading representation that goods are new, or that they are reconditioned, or that they were manufactured, produced, processed, or reconditioned at a particular time; or
(e) make a false or misleading representation that goods or services have any sponsorship, approval, endorsement, performance characteristics, accessories, uses, or benefits; or
(f) make a false or misleading representation that a person has any sponsorship, approval, endorsement, or affiliation; or
(g) make a false or misleading representation with respect to the price of any goods or services; or
(h) make a false or misleading representation concerning the need for any goods or services; or
(i) make a false or misleading representation concerning the existence, exclusion, or effect of any condition, warranty, guarantee, right, or remedy; or

June 28, 2011 at 12:30 am #10462Paul RothMemberThere is some case law on the Fair Trading Act, but each case is decided on its own facts. The main legal issue here (actually, mixed law and fact) would be whether the advertisements are actually misleading, or merely puffed up (eg, “Canada vrs USA”). I suppose it could depend on whether this is supposed to be taken as a real hockey game (which, unsanctioned as it is by the NZIHF and other bona fide hockey bodies, would be unlikely), or as simply an athletic event or demonstration akin to professional wrestling.
I checked the definition section of the Act out of curiosity, and “service” certainly includes amusements, entertainment and shows, so a demonstration hockey game would be covered under the Act.
There aren’t a lot of prosecutions under the FT Act (11 last year, 30 the year before), as most people are brought into line by informal CC inquiries, as here. I think what will influence whether the promoters here are prosecuted is whether people who attended the games will complain about being misled and ripped off. By that stage, however, the circus will have left town, and only the NZ promoter will be left to carry the can, not the Canadian guy who is organising the event. And if the NZ promoter has a limited liability company, the company could be wound up in the flash of an eye if there is any prospect of heavy penalties.

Played Islanders, Rangers, and Kings and St Louis Blues, didn’t get a full season on NHL to 02, despite being drafted in 92.So we are hardly talking the creme de la creme of the NHL, some good journey men, should be decent hockey. Also there Stanley Cup winning claims seem to be tenuous since the players I could find with rings, never played enough to get the name on the Cup.
